1. Wine Trove – Who we are and how to Contact us
1.1 Wine Trove is run by Paul Armstrong in a Sole Trader capacity, from his home address at Kintail, Moor Road, Langham, Colchester, Essex, CO4 5NR. Should you need to contact us for any reason, you may write to us at that address. You may also telephone 01206 271195, or email wine@winetrove.co.uk.
1.2 We are not VAT registered. There is no VAT payable on our prices, and no VAT is reclaimable by business customers.
1.3 We are AWRS registered. Our AWRS number is XZAW00000107709.
2. Minimum Order
There is no minimum order.
3. Prices And Payment
3.1 All prices are quoted in Pounds Sterling. Delivery charges are additional, where appropriate (see Clause 4 below).
3.2 We accept payment by Maestro, Visa, MasterCard and PayPal.
4. Delivery & Insurance
4.1 Orders will be delivered to any single UK address. Delivery for orders over £150 to a single UK mainland address is free. Orders under £150 will attract a delivery charge of £10 per single UK mainland address. You agree that we may use independent third parties to deliver the wines.
4.2 We can deliver to & accept orders from the Channel Islands & overseas. Please contact us for the current relevant charges that maybe applicable. Any duty incurred shipping internationally is the responsibility of the client.
4.3 We normally aim to deliver within 5 working days or less to UK mainland addresses (non-mainland UK and overseas delivery will take longer). If you need more urgent delivery, please contact us in advance of placing your order and we will advise our best delivery date. We are grateful for your understanding that occasionally delivery may take longer than our normal aim. While every effort is made to dispatch your orders within a few days of acceptance, please allow up to 30 days for delivery. In such cases, we will attempt to notify you and Wine Trove reserves the right to dispatch the order within a reasonable period of the occurrence of such delay.
5. Substitutions
We cannot guarantee the availability of all the products we advertise. In the event that a wine becomes unavailable we will contact you to advise a suitable replacement and/or offer a full refund for the missing bottle(s).
6. Cooling Off Period And Customer Guarantee
6.1 You are entitled to cancel your order, by contacting Wine Trove using the contact details provided at the beginning of this document, for a period of 14 working days from delivery to you.
6.2 The additional customer guarantee provided in Clause 6.1 above is intended for the benefit of all our customers. However, if we believe that a customer has abused this guarantee, we may decide to withdraw the benefit of the customer guarantee from that customer. Alternatively, we reserve the right to close that or any other account of the Customer without notice and/or refuse to accept any further orders from that customer. In these circumstances, our decision will be final.
7. Refunds
Refunds for returned bottles will be organised immediately on receipt of the wine(s) providing they remain in saleable condition. Returned wines which are deemed not to be saleable cannot be refunded and will result in redelivery. We will process the refund within 14 calendar days of receiving the wine back.
Please be aware that any refunds to a credit card will be processed immediately by us, but may take between 3 - 10 days to appear on your statement. However, we reserve the right to deduct from the amount refunded the cost of returning the wine to Wine Trove.
8. Wines
8.1 Wine Trove is committed to providing our customers with an exceptional level of service. All our stock is stored in a cool, dark air-conditioned cellar facility suitable for long-term wine storage.
8.2 In many instances, an accurate condition report is presented for such wines on our website. Purchasers of fine and rare, or older bottles of wine must take into account natural variations in fill and the conditions of the label, cork and wine.
8.3 Please note that a refund or credit will only be offered at our complete discretion in the event of a corked or oxidised wine, and that we reserve the right to request the return of any suspect bottle in order to verify its condition.
8.4 We are unable to accept responsibility for the condition of wines purchased by us in good faith, where the contents of the bottle does not correspond to the drinking experience implied by its description and/or professional review.
8.5 If, on delivery, a product does not meet with your complete satisfaction, please inform us within 14 days of receipt, and we will organise to have it collected. A refund will be issued subject to the product remaining in a saleable condition.
9. Age Restriction
9.1 By placing an order you are confirming that you, and the intended recipient, are 18 years of age or over. We cannot sell wine to, or intended for, anyone who is under 18. You may be asked to provide proof of age prior to delivery.
9.2 If you are buying wine as a gift the recipient must also be 18 years of age or older.
10. Vouchers
10.1 Should you receive a voucher to redeem against the purchase of wine from us you agree to be bound the terms and conditions on that voucher.
10.2 Vouchers are not transferable and may not be sold or auctioned.
11. Force Majeure
11.1 The company will not be liable for failure to meet agreed obligations due to prevailing circumstances beyond our reasonable control.
12. Data Protection and Privacy Policy
12.1 Wine Trove is committed to preserving the privacy of all visitors to its website. By registering, visiting or placing an order with Wine Trove, you consent to the collection, holding, use and transfer of certain information about yourself and your usage of (and communications with) this website and our telephone ordering system, in accordance with these terms and conditions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.
12.2 Your information will enable us to provide you with access to our site, to supply the goods you have requested and inform you of promotions and special offers. It will also enable us to bill you and to contact you where necessary concerning your orders. We will also use and analyse the information we collect so that we can administer, support, improve and develop our business. In particular, we may use your information to contact you for your views on our services and to notify you occasionally about important changes or developments to the site or our services. Further, where you have consented, we might also use your information to let you know about other products and services which we offer which may be of interest to you and we may contact you by post, telephone or fax, as well as by e-mail. If our business enters into a joint venture with or is sold to or merged with another business entity, your information may be disclosed to our new business partners or owners. If you change your mind about being contacted in the future, please let us know by contacting the Customer Services department, the details can be found in clause 1 of the terms and conditions.
12.3 Unless required to do so by law, we will not otherwise share, sell or distribute any of the information you provide to us without your consent.
12.4 Cookies are small amounts of information which we store on your computer. Unless you have indicated your objection when disclosing your details to us, our system will issue cookies to your computer when you log on to the site. Cookies make it easier for you to log on to and use the site during future visits. They also allow us to monitor website traffic and to personalise the content of the site for you. You may set up your computer to reject cookies although, in that case, you may not be able to use certain features on our site.
12.5 We employ security measures to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage. We will retain your information for a reasonable period or as long as the law requires.
12.6 You are entitled to see the information held about you and you may ask us to make any necessary changes to ensure that it is accurate and kept up to date. If you wish to do this, please contact us. We are entitled by law to charge a fee of £10 to meet our costs in providing you with details of the information we hold about you.
12.7 Any changes to the privacy policy, contained in this Clause 12, will be posted to the site and, where appropriate, through e-mail notification.
12.8 All comments, queries and requests relating to our use of your information are welcomed and should be addressed to the contacts detailed in Clause 1 above.
13. Warranty; Limitation on Liability
13.1 We warrant that the wines will be of satisfactory quality and fit for their general purpose, but make no other warranty with respect to the wines except as required by law and as set out in Clause 6 and Clause 11.
13.2 Nothing in these Terms and Conditions shall exclude our liability for personal injury or death caused by our negligence.
13.3 We will not be liable for any loss or damage caused by us or agents in circumstances where such loss or damage: was not foreseeable to both us and you when the contract was formed; was not caused by any breach on our part; and/or relates to business and/or non-consumers.
13.4 Subject to Clause 13.2 above we will not be liable for loss or damage caused by your handling the wine. In particular we will not be liable for spillages or breakages.
13.5 Customers should also be aware of the following inherent risks and warnings: Alcohol should be consumed in moderation. A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time. Sparkling wines and champagnes can be volatile due to the build up of gasses so extra care should be taken when opening these.
14. Changes to these terms and conditions
14.1 We may amend these terms and conditions from time to time without notice.
15. Governing Law and Jurisdiction and codes of conduct
15.1 These terms and conditions and the relationship between Wine Trove and you shall be governed by and construed in accordance with the laws of England and Wales and you irrevocably agree to submit to the exclusive jurisdiction of the courts of England and Wales over any claim or matter arising under or in connection with these terms and conditions or the legal relationship established between you and Wine Trove.
15.2 There are no codes of conduct applicable to any contract between Wine Trove and you.
